BGH Judgment – BGH Prevents Mutilation of a Girl

A five-year old was to be brought to her grandmother in Gambia by her Gambian mother living in Germany. The girl was threatened with genital mutilation. TARGET alerted the Youth Welfare Office, the Public Prosecution Service and the government minister Heidemarie Wieczorek-Zeul. With success.

The mother lost her right to determine her child’s place of abode and was transferred to the Youth Welfare Office. The mother took legal action.

The case finally passed to the Federal Court of Justice (BGH). The court passed a judgement on 15/12/2004 setting a precedent. You can access the BGH judgement above using the link of the same name.
